§ 342-25. Specifications.

Whenever a plan is made for the laying out of a new way over private property, such way shall be laid out no less than 40 feet wide and the owners of the land over which the way is laid out shall be required to remove all turf, loam, stumps, stones and other obstructions and the said owners of the land shall prepare the roadway, sidewalks and drainage to the satisfaction of the Highway Surveyor who has control of the repair of highways. Nothing in this section shall prohibit the acceptance of a Way which has been approved by the Planning Board under the Subdivision Control Law under a bond or otherwise of money for the purpose of completing the construction of such a Way.
